Vehicle owner prosecuted for fly tipping

The owner of a vehicle used in a fly tipping incident in Eynsford, Kent has been prosecuted by Sevenoaks District Council.

Tony Keogh, the Director of Bespoke Swimming Pools Ltd, appeared before Sevenoaks Magistrates’ Court on Friday 17 January 2025.

Mr Keogh pleaded guilty to knowingly causing or permitting fly tipping on the public highway whether or not he gave any instructions for this to be done.

The case was brought to court following an investigation by the Council’s Environmental Enforcement Team.

The illegal fly tip took place at 5.20pm on 14 February 2024 in Crockenhill Lane, Eynsford.

The waste was tipped from a vehicle owned by Bespoke Swimming Pools Ltd, blocking the road. Mr Keogh was not believed to be driving the vehicle at the time of the incident.

The Council was initially contacted by a resident who witnessed the offence. The witness recorded part of the vehicle registration. Automatic Number Plate Recognition (ANPR) evidence later confirmed the vehicle was in the area at the time of the offence.

The fly tip also included a sign written tailgate from the vehicle that dumped the waste.

At court, Mr Keogh was handed fines and costs totalling £670 (a £300 fine for the offence, £250 in Council costs and a £120 victim surcharge). 

Cllr Irene Roy, Sevenoaks District Council’s Cabinet Member for Cleaner and Greener, says: “This case sends out a stark warning to vehicle owners. Where there is evidence, we will take action if their vehicle is used for fly tipping.”
